Heeler Haven Adoption Contract 

This is a Binding and Legal Contract between the following parties: This agreement is made on ____________________, between Melissa T. Dorminey (hereinafter referred to as "Foster Home") and ___________________________________ (hereinafter referred to as "Adopter").

Foster Home

  1. Foster Home guarantees that to the best of her knowledge, this dog is in good health and free from communicable disease at the time of adoption.  Foster Home has provided for current vaccinations and neutering.
  2. Foster Home makes no guarantees explicit or implied regarding the health of the animal to be adopted except as otherwise stated under article one (1.).
  3. Foster Home guarantees that adoptee has not been found to be of a temperament that is unsuitable in a family home environment.  This guarantee only applies to the limited time the adoptee has resided at the Foster Home.

4.      In the event that any issues become evident that adopted animal can no longer be maintained or cared for by Adopter, the Foster Home guarantees to accept the adopted animal back into foster care.

5.      Foster Home requests an $150 adoption fee/donation.  The veterinarian of the Foster Home provides services for the rescued animals at a much reduced rate.  The Adoption fee is used for vaccinations, neutering and microchip identification.  This is the only fee/donation that is associated with the adoption of the animals.
For animals adopted that have not been altered, the foster home requests an $100 adoption fee.  Please understand, these fees go toward the health of all the dogs fostered at Heeler Haven Rescue, Inc. not just the animal that is being adopted.  Many animals come onto the farm sick, injured, etc.  The donation/adoption fee is not specifically for the animal that is being adopted.

Australian Cattle Dogs are not for everyone and we hope that you research the breed thoroughly before deciding to adopt one. They are extremely active and need a LOT of attention. It takes a very dedicated owner to own an Australian Cattle Dog.

Adopter

  1. Adopter agrees to take good and reasonable care of this dog, providing for all of its annual immunizations and other medical, physical and emotional needs.
  2. Adopter agrees to provide Foster Home with pictures of dog at six months, one year, two years from adoption date.  Pictures may be e-mailed to mtdorminey@4dacres.net as attachments or hardcopy pictures may be mailed to: 4D Acres Farm, 3071 Sam Moss Hayes Road, Oxford, NC 27565.
  3. Adopter agrees that if at any time if becomes necessary to place this dog, the Foster Home will be contacted (4D Acres Farm, 3071 Sam Moss Hayes Road, Oxford, NC 27565  Phone: 919-528-3665).  Foster Home does not ever refuse any ACD and will gladly take the animal back into foster care.
  4. Adopter agrees that at no time will this dog be abandoned, turned over to a pound, humane society or animal shelter as a means of disposal.
  5. Adopter guarantees that at no time will this dog be chained or otherwise tied out, and it will not be allowed to run free unsupervised.
  6. Adopter agrees to be responsible and to obey the local dog ordinances of the municipality where the dog is resident.

In the event the Adopter fails to perform any provision of this agreement including those acts which he has warranted and guaranteed to perform, then and in such event the Foster Home may at her option, revoke this agreement of adoption and retake possession of this dog with Adopter forfeiting all further rights to the dog and the cash adoption fee paid to the Foster Home as liquidated damages for the breach of this agreement and of the warranty and guaranty.  

We have read and understand the above conditions of adoption and agree to the terms of this contract. Any litigation involved in the enforcement of this contract shall be entertained in the State of North Carolina and subject to its laws.

We reserve the right to refuse to place a rescued animal in an environment unsuitable for that animal or the potential adopters.
