Purchase Contract & Monetary Consideration

This is a Binding and Legal Contract between the following parties: This agreement is made on ______________, between Melissa T. Dorminey (hereinafter referred to as "Breeder") and ______________________ (hereinafter referred to as "Buyer") .

Breeder

1. Breeder guarantees that to the best of her knowledge, this dog is in good health and free from communicable disease at the time of purchase.
2. Breeder guarantees that the above dog is purebred and registerable with the American Kennel Club. (AKC) 
3. Breeder guarantees that this dog may be returned to the breeder within two (2) weeks of the purchase date if a problem arises with the health or temperament of the puppy. It is recommended that the puppy be examined by a veterinarian during this period. If a problem exists, the dog will be replaced, or the purchase price refunded.
4. Breeder guarantees that parents have been tested and found clear of PRA within a year of said breeding, and have been OFA or pre-limb'd by OFA.

5.   In the event that any defect or health problem arises, we only require that you send us proof that the dog has been spayed or neutered and let you keep it. We will either give you another puppy or a partial or full refund (depending on the problem) of the purchase price. (The refund of the partial or full purchase price is negotiable.) If you feel that you no longer want the puppy because of whatever health problem it has, we will gladly take it back into our home.

6.   We abide by ACDCA Breeders' Code of Ethics.

Buyer

1. Buyer agrees to take good and reasonable care of this dog, providing for all of its annual immunizations and other medical, physical and emotional needs.
2. Buyer agrees to provide breeder with pictures of dog at six months, one year, two years and 3 years.
3. Buyer agrees that if at any time if becomes necessary to place this dog, the Breeder will be contacted.  We do not ever refuse any ACD and will gladly take the animal back into our home.
4. Buyer agrees that at no time will this dog be abandoned, turned over to a pound, humane society or animal shelter as a means of disposal.
5. Buyer guarantees that at no time will this dog be chained or otherwise tied out, and it will not be allowed to run free unsupervised.
6. Buyer agrees to be responsible and to obey the local dog ordinances of the municipality where the dog is resident.
7. Upon completion of any AKC titles, a copy of the AKC certificate will be sent to the above named seller within 60 days.

In the event the Buyer fails to perform any provision of this agreement including those acts which he has warranted and guaranteed to perform, then and in such event the seller may at her option, revoke this agreement of sale and retake possession of this dog with buyer forfeiting all further rights to the dog and the cash consideration paid to the seller as liquidated damages for the breach of this agreement and of the warranty and guaranty. Any such AKC Registration papers shall also be promptly signed and returned to Buyer.

 We have read and understand the above conditions of sale and agree to the terms of this contract. Any litigation involved in the enforcement of this contract shall be entertained in the State of North Carolina and subject to its laws.

We breed the individual for conformation, agility, herding ability and personality.

4D Acres is not a "puppy farm".  Our litters are carefully bred for specific purposes to produce the best Australian Cattle Dog that can be bred.  We do offer pups for sale as "pets" (neutered with limited AKC registration).  These animals are of the same quality as our breeding and show dogs.  The "pet" option is available to those individuals that wish to befriend the best dog they will ever know, but who may not wish to breed or show the dog.  Buyers of pups  with full AKC registration without the requirement to be neutered are carefully selected based on the buyer's desire for the pup, the appropriate responsibility of producing any offspring from that pup, and on the pup's welfare.

We reserve the right to refuse to sell to a buyer.
